All the general noises coming out of FCC since Chairman Genachowski started
talking about it explicitly a few weeks back have been good.

However, as with all such dynamics in public government, it's a good idea
to keep up the bottom-up communication (which this web site enables) and
NGO lobbying along the way, because nothing is a done deal yet, in detail.
One positive sign is that the newest commissioner, Mignon Clyburn, seems
inclined to go along with Genchowski and Copps in this area, rather than
being some sort of question-mark and potential swing vote.  But again, this
is hardly more than reading tea leaves, with substantial room for doubt on
the details.

IMHO this sort of thing (application of the principle of common carriage to
the Internet) should be established in statute, not simply in an agency
regulation.  Administrations come and go, but statutes are more long-lived,
and the common carriage principle is not one that should wax and wane
according to the tides of the political moment.

This football should be taken out of the immediate political game to the
extent possible.
