Hello all,

If you have time and are interested in data protection I recommend you read this factsheet
from the European Commission on international cooperation and the new data protection
rules to be approved.

europa.eu/justice/data-protection/document/review2012/factsheets/5_en.pdf

I have already mentioned at some point that one of the new challenges for the new WHois system will be that
in a near future, from a legal perspective, there will be EU data protection standards applied independently of
the location where the data of the European citizens is processed outside or inside the EU. It seems to me
that the EWG missed this key aspect. As far as data protection for EU registrants are concerned,
it will be somewhat irrelevant where the central database or the registrar or registry will be located.
It will be relevant for other reasons ( security, etc.).

We are heading towards a dual data protection system for registrants, it looks like it will soon be a
EU registrants versus non-EU registrants system which of course will probably have a lot of consecuences
( business impact, consumer protection, etc.)

Best,

Marie-laure
