I may be old and thick headed here but I agree. We start with who and 
what we want to protect, then figure out how we protect that. Then we go 
to design, and in both beta mode and in implementation we run continuous 
impact assessments, probably building up a pile of case law and 
legislation in the process - as well.....maybe....also better registrar 
and registry agreements. If we are going to design, measure, evaluate 
and learn, we have to get  specific about what we are trying to protect.
